5 Things Trans Voters in Texas Need to Know
I’m sure you already know since it’s on everyone’s feeds right now, but Early Voting starts on Tuesday, Oct. 13! Even though voting is not the end-all, be-all solution to dismantle oppressive systems that continue to hurt our communities, voting is still a key part of our participation in society and having our voices heard in the issues that affect us all. Everyone should be able to vote safely regardless of their gender identity.
I’m non-binary. Before I started working at the Texas Civil Rights Project, I had no idea of my own voting rights as a trans person. 1. Does the name on my ID need to match my name as listed on the voter registration rolls?
No. The Texas Secretary of State’s Office states: "Voters do not need to show additional documentation if their names are identical or substantially similar.”
2. Does the gender marker on my ID need to match the gender listed on my voter registration application?
No, there is no legal requirement for that in Texas law. If a poll worker challenges you on your gender marker, you can immediately call the Election Protection hotline (866-OUR-VOTE) for assistance.
3. Can a poll worker ask me questions about my medical history to determine whether I am the same person as on the rolls?
No, a voter is under no obligation to provide confidential medical history to prove their eligibility to vote.
4. Can I still vote if I don’t look like the picture on my ID anymore?
Yes! But if you don’t look like the picture on your ID anymore, you may have to cast a provisional ballot. If that happens, your ballot will still be counted once you submit an affidavit confirming your identity.
